Plain Language Summary

SMScene sells you access to an export page where you can render and re-render your SMS animation as many times as you need. We are not responsible for the quality of the output because it is produced entirely by your web browser. By using this service you agree to all terms below.

1. Acceptance of Terms

By accessing or using SMScene (the "Service"), creating an account, or completing a purchase, you ("User") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") in full. If you do not agree, you must not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service following any modification constitutes your acceptance of the revised Terms.

2. Description of Service

SMScene provides a web-based tool for creating animated message-thread simulations ("Scenes"). The Service includes a browser-based preview, a timeline editor for adjusting message timing, and an export feature for rendering the animation as a video file.

We are committed to the continuous improvement of the Service. This includes ongoing updates to frame designs, rendering pipelines, UI features, and system stability. We reserve the right to modify, update, or discontinue any part of the Service at any time without notice.

3. Export Page Access & Payment

Payment constitutes the purchase of a license to access a specific export page for a given project ("Export Access"). This access is persistent and grants the User the right to:

  • Preview and play back their animation an unlimited number of times.
  • Adjust the timing and delays between messages without requiring an additional payment.
  • Initiate the in-browser rendering process as many times as needed, including from different browsers or devices.
  • Record the on-screen preview using third-party screen recording software of their choosing.

The following changes constitute material modifications to a project and require a new export purchase:

  • Changing, adding, or removing message content (text, images, or media).
  • Changing the phone frame or device model selected for the scene.
  • Changing or replacing the scene background (image, video, or color).
  • Adding, changing, or removing any audio — including sound effects, background music, or voice-over tracks.

All payments are final. SMScene does not offer refunds except where required by applicable law.

4. Disclaimer of Liability — Export Quality

The export rendering process is powered by FFmpeg compiled for WebAssembly, which executes entirely within the User's web browser environment. SMScene does not control and is not responsible for:

  • Visual artifacts, color inaccuracies, frame drops, or encoding errors that result from browser limitations or incompatibilities.
  • Performance degradation on low-powered devices.
  • Rendering failures caused by browser updates, security policies, or memory constraints.
  • Differences in output quality between browser engines (e.g., Chrome, Firefox, Safari).

By completing a purchase, the User expressly acknowledges and accepts that export quality is inherently variable and entirely dependent on their browser and hardware. We strongly recommend using a modern, up-to-date browser (such as Google Chrome) for optimal results. The ability to re-render unlimited times from any browser is provided specifically to allow the User to mitigate these limitations.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMSCENE PROVIDES THE EXPORT FEATURE "AS IS" AND EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE. SMSCENE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE EXPORT FEATURE.

5. Frame Accuracy & Iterative Design

SMScene offers a library of device frame simulations, including "Basic" and "Premium" frames, that are designed to visually replicate the look and feel of popular messaging interfaces. These frames are original creative interpretations and are not exact 1:1 replicas of any third-party software, operating system, or manufacturer's UI.

Frame designs are subject to change, refinement, and improvement over time as we iterate and receive feedback. If a frame known to you as purchased contains inaccuracies or design issues, we may fix these in a subsequent update at no additional cost. However, we make no guarantee that any specific frame will achieve a specific level of visual fidelity.

SMScene is not affiliated with, endorsed by, or in any way officially connected with Apple, Google, Samsung, Meta, or any other company whose interface may be referenced in our frame designs.

6. User Content & Responsibility

You are solely responsible for all message content, images, and media you add to your Scenes. You represent and warrant that your content does not violate any law or infringe upon any third-party rights. SMScene does not review user-generated content and accepts no responsibility for it.

7. Intellectual Property

All website design, code, branding, and original frame assets are the intellectual property of SMScene and are protected by applicable copyright and trademark laws. You retain ownership of the creative content (messages) you create using the Service. SMScene is granted a limited license to store and process your content solely for the purpose of providing the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction.
